1. Agreement to Terms

By accessing and using ZeroTouch Mail AI ("the Service," "we," "us," "our," or the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These Terms of Service constitute a binding agreement between you and ZeroTouch Mail AI regarding your use of the Service.

2. Description of Service

ZeroTouch Mail AI is a cloud-based email management and AI-powered lead recovery platform that enables users to:

• Connect and manage Gmail accounts through OAuth integration
• Send and receive emails through the platform
• Generate AI-powered email responses and drafts using Claude AI
• Detect and track appointment confirmations in emails
• Create and manage email sequences and templates
• Analyze email intent and manage lead follow-ups
• Track email analytics and campaign performance

3. User Eligibility

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal authority to enter into a binding agreement
• Possess a valid email account
• Comply with all applicable laws and regulations
• Have a legitimate business purpose for using the Service

You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

4. Account Registration and Responsibility

When you create an account, you must provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your password and login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your contact information remains current

We are not responsible for any loss or damage arising from your failure to protect your account credentials.

5. Gmail Integration and Email Access

By connecting your Gmail account, you authorize the Service to:

• Read, send, and manage emails on your behalf
• Access your Gmail contact information and email history
• Process email content through AI models for analysis and response generation
• Store email metadata and content for service operation

Important: You are solely responsible for the emails you send through the Service. We do not filter or review emails before sending. You must ensure all email content complies with applicable laws and Google's policies.

You can disconnect your Gmail account at any time, which will revoke our access to your Gmail account.

6. AI-Generated Content and Responses

The Service uses Claude AI (by Anthropic) to generate email drafts and responses. Please understand:

• AI-generated content is automated and may not be perfect
• You are responsible for reviewing and editing all AI content before sending
• We do not guarantee the accuracy or appropriateness of AI suggestions
• You must ensure all sent emails comply with laws, regulations, and best practices
• The Service is not liable for errors, misstatements, or problems in AI-generated content

Use AI-generated content as a starting point only, not as final communication.

7. Prohibited Uses

You agree not to use the Service for:

• Sending spam, phishing emails, or unsolicited bulk messages
• Harassing, threatening, or abusing individuals
• Violating anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
• Impersonating others or misrepresenting your identity
• Violating intellectual property rights of others
• Accessing or attempting to access accounts that are not yours
• Disrupting or degrading the Service or its infrastructure
• Reverse-engineering, hacking, or attempting to exploit the Service
• Any illegal or fraudulent activity
• Any activity that violates Google's Terms of Service or OAuth policies

Violation of these prohibitions may result in immediate account termination and legal action.

8. Intellectual Property Rights

Your Content: You retain all rights to the content you create and email data you provide. We have the right to use your data solely for operating and improving the Service.

Service IP: All trademarks, logos, code, design, and content of ZeroTouch Mail AI (excluding user-provided content) are the exclusive property of ZeroTouch Mail AI or its licensors. You may not reproduce, modify, or distribute any part of the Service without permission.

9. Payment Terms

If you purchase a paid plan:

• You authorize us to charge your payment method on a recurring basis
• Billing occurs at the beginning of each subscription period
• All fees are non-refundable except as required by law
• We may change pricing with 30 days' notice
• You are responsible for all applicable taxes
• Failed payments may result in service suspension

10. Disclaimer of Warranties

We disclaim all express, implied, and statutory warranties, including:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties that defects will be corrected
• Warranties regarding accuracy of AI responses

While we strive to maintain service quality, we make no guarantees about uptime, performance, or results.

11. Limitation of Liability

This includes damages for lost profits, lost data, business interruption, or any other loss, even if we have been advised of the possibility of such damages.

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ZeroTouch Mail AI from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Any content you send or generate through the Service
• Your violation of any third-party rights (including Google's policies)

13. Termination

By You: You may terminate your account at any time by contacting us or deleting your account through the Service settings.

By Us: We may suspend or terminate your account immediately if:

• You violate these Terms of Service
• You use the Service for illegal or fraudulent purposes
• You send spam or engage in abusive behavior
• You violate Google's policies or terms
• Your account poses a security risk

Upon termination, your access to the Service will end, and we may delete your data after 30 days (unless required to retain it by law).

14. Data Retention and Deletion

When you delete your account, we will remove your personal information within 30 days, except:

• Data retained in backups (typically 30-90 days)
• Data required by law (tax records, fraud prevention, etc.)
• Email data in your Gmail account (remains in Google)

15. Compliance with Laws

You are responsible for ensuring your use of the Service complies with all applicable laws, including:

• CAN-SPAM Act (USA): Anti-spam email regulations
• GDPR (EU): Data protection and consent requirements
• CASL (Canada): Canadian anti-spam law
• Local Laws: Any other applicable regulations in your jurisdiction

We are not responsible if your use of the Service violates any law. Violation of anti-spam laws may result in account termination and legal consequences.

16. Third-Party Services

The Service integrates with third-party providers:

• Google (Gmail API): Governed by Google's Terms of Service
• Anthropic (Claude AI): Governed by Anthropic's terms
• Stripe (Payments): Governed by Stripe's terms

We are not responsible for these third parties' actions, policies, or service availability.

17. Changes to Terms

We may update these Terms of Service at any time. Significant changes will be communicated to you via email or notification in the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the United States.

19. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through:

1. Good faith negotiation between the parties
2. Binding arbitration if negotiation fails

You waive any right to a jury trial or class action lawsuit.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
